1. Acceptance and eligibility

By purchasing, downloading, installing, accessing, or using the KeyBlock hardware, mobile application, website, or related services (“Services”), you agree to these Terms and our Privacy Policy.

Eligibility

You must be at least 18 to use the Services on your own. If you are between 13 and 17 (or the age of digital consent where you live), you may use the Services only with verifiable consent from a parent or guardian who accepts these Terms on your behalf. The Services are not intended for children under 13.

You represent that you have legal capacity to enter this agreement, that your information is accurate, and that your use complies with applicable law. We may restrict the Services where required by law.

2. Description of Services

KeyBlock combines hardware and software to help you manage smartphone distractions, including through proximity-based interaction (such as NFC) where supported, so that changing blocking settings may require physical presence at your chosen location.

Through the app you may, among other things:

  • Choose apps or sites to limit during active sessions (subject to platform rules)
  • Configure modes for different activities
  • View usage-related statistics we make available
  • Use limited emergency override features where offered
  • Manage account and device pairing

The Services may include cloud features, updates, and support. We may modify, suspend, or discontinue features where reasonably necessary. Beta or experimental features may be offered “as is” and withdrawn without notice.

You need a compatible device, app store access, and an account where required. Availability varies by region and platform.

3. Prohibited uses

You agree not to:

  • Reverse engineer, decompile, or circumvent security or usage limits except where law forbids such a restriction
  • Interfere with or overload the Services or use unauthorized automated access
  • Use the Services for illegal, fraudulent, or harmful purposes, or to harass others
  • Misrepresent identity, scrape personal data from the Services, or resell the Services without authorization
  • Upload malware or infringe others’ intellectual property or privacy

We may investigate violations and suspend or terminate access, remove content, or involve law enforcement where appropriate.

4. Accounts and security

Full use of the hardware may require creating an account with accurate information. You are responsible for credentials and all activity under your account. Notify us immediately at support@keyblock.app if you suspect unauthorized access.

We may suspend accounts for suspected compromise or violations. You may close your account as described in the app or by contacting us; retention of data is described in our Privacy Policy.

5. Mobile application terms

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the KeyBlock mobile app on devices you own or control for personal, non-commercial use with your KeyBlock hardware.

Downloads from the Apple App Store are also subject to Apple’s terms. Apple is a third-party beneficiary of the license portions of these Terms as needed for its rules.

We may provide automatic updates. You are responsible for data charges. Open-source or third-party components may be governed by separate licenses. Except for the license granted, we retain all rights in the app.

6. Billing and payments

If you purchase hardware or other paid offerings, you authorize us and our payment processors to charge your payment method for the amounts shown, including applicable taxes and shipping. Prices may change for future purchases; confirmed orders are honored at the price charged at checkout.

Failed payments may result in cancellation after notice. International orders may incur duties or fees that are your responsibility. We may introduce subscriptions or paid features in the future with separate terms.

7. Refunds and returns

Return and refund policies in effect at the time of your purchase apply. Contact support@keyblock.app with your order details before returning any product unless we provide a self-serve flow. Defective products may be repaired or replaced according to our then-current policy.

If you are a consumer in the EU, EEA, or UK, you may have a statutory withdrawal period for distance sales; exercise any such right as required by applicable law and our instructions.

8. Intellectual property

The Services, including hardware design, software, branding, and content (“KeyBlock Content”), are owned by KeyBlock or licensors. Except for the limited licenses in these Terms, no rights are granted. You may not copy, modify, or create derivative works of KeyBlock Content except as allowed by law.

Feedback you provide may be used without restriction or compensation. You represent you have rights in any content you submit. For copyright complaints, contact support@keyblock.app.

9. Privacy and communications

Our Privacy Policy explains how we handle personal information. By using the Services, you agree to electronic notices and service-related communications at the email on your account. Marketing messages are optional where law allows; use unsubscribe links or contact us to opt out.

If we offer SMS, carrier rates may apply; you can opt out as instructed in those messages.

10. Disclaimers and warranties

If applicable law requires, we provide certain consumer warranties for hardware defects. Otherwise, except as expressly stated, the Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant uninterrupted or error-free operation, compatibility with every device, or that blocking will meet every use case. Third-party services and app-store policies are outside our control. Nothing here limits non-waivable statutory rights.

11. Limitation of liability

To the maximum extent permitted by law, KeyBlock and its affiliates, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, or exemplary damages, or lost profits or data, arising from the Services.

Our aggregate liability for claims relating to the Services is limited to the greater of (a) amounts you paid to us for the Services in the six months before the claim or (b) the purchase price of your KeyBlock hardware, except where liability cannot be limited by law (including gross negligence, fraud, or death/personal injury in jurisdictions that prohibit exclusion).

12. Indemnification

To the extent permitted by law (and not for UK/EU/EEA consumers where barred), you will defend and indemnify KeyBlock against claims arising from your use of the Services, your violation of these Terms, or your violation of others’ rights, except to the extent caused by our gross negligence or willful misconduct.

13. Dispute resolution

Governing law: These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law rules, except where mandatory consumer laws of your country apply.

Informal resolution: Before filing a claim, send a written description of the dispute to support@keyblock.app and allow sixty (60) days to attempt resolution in good faith.

Arbitration: Except where prohibited, disputes will be resolved by binding arbitration administered by the AAA under its Commercial Arbitration Rules, with the seat in Chicago, Illinois. Each party may bring claims only in an individual capacity, not as a class or representative action. You may opt out of arbitration within thirty (30) days of first accepting these Terms by emailing a clear opt-out notice to support@keyblock.app with your name and contact details.

Either party may seek injunctive relief in court for IP or urgent harm. Small claims court may be used where permitted. If part of this section is unenforceable, the remainder stays in effect to the fullest extent.

14. Termination

We may suspend or terminate access for breach or other reasons as permitted by law. You may stop using the Services at any time. Provisions that by nature should survive (including IP, disclaimers, liability limits, indemnity, and dispute resolution) survive termination.

15. Third-party services

App stores, payment processors, carriers, and other third parties have their own terms. We are not responsible for third-party services, content, or failures.

16. Export controls

You must comply with applicable export and sanctions laws. You may not export or transfer the Services to prohibited countries, entities, or persons.

17. General provisions

These Terms and the Privacy Policy are the entire agreement regarding the Services. If a provision is invalid, the rest remains enforceable. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.

We may update these Terms; material changes will be posted or communicated as appropriate. Continued use after the effective date may constitute acceptance where allowed by law.
